On the heels of Yale breaking theira 54-year NCAA Tournament drought, their former captain at the start of the season is suing the school.

Former Yale men’s basketball captain Jack Montague released a statement stating he intends to sue the university after he was expelled last month for sexual misconduct.

Montague was expelled from Yale in February after an alleged incident took place between him and a female student. The victim claims the two were a consensual relationship which turned nonconsensual – a claim Montague disputes.

“We strongly believe that the decision to expel Jack Montague was wrong, unfairly determined, arbitrary, and excessive by any rational measure,” the statement read. “Yale has been oblivious to the catastrophic and irreparable damage resulting from these allegations and determinations.”

Montague’s statement said he was never accused of rape, and the university did nothing to correct the claims. It also claims the timing of the expulsion if is fishy given the AAU’s report which was critical of Yale’s handlings of sexual assault. Montague appealed the decision, but the ruling was upheld.

In a statement to Jezebel university spokesman Tom Conroy declined to comment due to respect for privacy of all parties. However, he did say the procedure for the allegations was “thorough and fair.”

“One out of five formal sexual misconduct hearings ends without a finding against the accused, and, in two out of five cases, the accused student receives a reprimand or probation,” Conroy wrote. “Only about one out of 10 cases ends in expulsion, and the decision to expel a student is made only after the most careful consideration, based on the facts and, when appropriate, disciplinary history.”

Montague’s statement claims he was made a “whipping boy” and said his lawsuit will vindicate his rights.

The rest of the Yale basketball team will take on Baylor in the first round of the NCAA Tournament on Thursday.
