The tragic boating accident that resulted in the death of Miami Marlins pitcher Jose Fernandez continues to be investigated to determine as much as possible regarding how the accident happened. Today, The Miami Herald reports toxicology tests have been completed but have not been released to the public just yet.

However, divers who took part in the recovery of Fernandez and two other bodies from the scene reportedly smelled alcohol on the accident victims.

As the investigation continues, more information will continue to come out as we await a full report of the accident. Investigators at this time believe they have evidence whoever was driving the boat was doing so at a high speed and may have been reckless in handling the vessel that crashed into rocks along the shoreline. It is believed by investigators whoever was in control of the boat was also under the influence of alcohol, and it is not known if Fernandez was the one driving the boat.

“The main question here is who was driving, obviously that’s the person most negligent, but even if Fernandez wasn’t driving, he may be negligent by virtue of entrusting someone who was intoxicated to drive the boat, which was his,’’ Miami-based Maritime attorney Michael Moore said. While there may be nobody alive to be charged, investigators will continue to gather information to determine if anyone can be held responsible in a civil lawsuit.

In other words, this sad story may have a way of dragging out some pain and suffering for quite some time. It is too early to know if that will be the case or not though, as the investigation will continue to come to a final decision.
