Brett Favre has been in the news lately, and not for anything particularly good either. The Hall of Fame quarterback made an interesting legal move as he sued sports media personalities Pat McAfee and Shannon Sharpe. The defamation lawsuit comes on the heels of Favre believing the Mississippi State auditor appeared to talk about Favre in order to “advance his political career.”
Never afraid to face any bluster, McAfee stood tall in the face of the lawsuit. The former Colts punter, media personality, and sometimes WWE commentator told Favre he’d “see him in court, pal.” Evidently, that got him attention from Favre’s lawyer.
His lawyer, Eric Herschmann, appeared on the Fearless podcast hosted by Jason Whitlock. On the podcast, Herschmann warned McAfee that he could be bankrupted after the lawsuit proceedings conclude.
Via Awful Announcing, Herschmann said:
“[McAfee], contrary to what Shannon Sharpe was probably told, ‘this is a good time to keep your mouth shut,’ decided to go on and speak again and make a joke that he doesn’t have a lawyer and that his wife says he’s really terrible about apologizing,” Herschmann continued to Whitlock. “Well, I guarantee you the jury in Mississippi will make certain he learns how to apologize. It’s going to cost Pat McAfee millions of dollars. And if it bankrupts him, then he will have learned his lesson about you don’t try to promote yourself by inappropriately and improperly attacking somebody else.”
Does the name Eric Herschmann sound familiar to you? If it does, it’s because he represents President Donald Trump. The collection of Herschmann, Trump, Favre and, even to a degree Jason Whitlock, is a pretty absurd collection of people. And so, such comments from Herschmann about McAfee don’t come too surprising.
After plenty criticized the legal move from Brett Favre, plenty more bashed his lawyer’s statements on Wednesday. The sports world took aim at Favre, his lawyer, and the ridiculousness of it all once again.

1. This is really dumb and a complete abuse of the courts.
2. Do we know just how Favre is funding this little lawsuit? Like, whose money is he using? His own or…. https://t.co/nryaMoj9V2— Evan (@ereller25) February 15, 2023
Did Favre hire an 8 year old to be his lawyer? https://t.co/1dHphwYEQP

Favre’s lawyer is going to bankrupt Favre if they go forward with this idiotic lawsuit. Hope Brett saved some of his Copper Fit money! https://t.co/DqkepnkZoN

A reminder that Brett Favre's laywer is Eric Herschmann, the former Trump White House attorney who had the wacky art on his wall during the Jan 6th hearingshttps://t.co/8TUsAZntVW pic.twitter.com/RMdYqr6YGf
