In May, kicker Josh Lambo filed a lawsuit against the Jacksonville Jaguars over being kicked and verbally abused by then-head coach Urban Meyer. On Wednesday, the NFL franchise filed a motion to dismiss it, according to court documents.

As reported by The Athletic, the team alleges that Lambo, who was cut by the Jaguars a few weeks into the season, did not reply to a follow-up after his agent reported the incident.

“Club’s legal counsel ‘acknowledged and responded immediately to the query made by Lambo’s agent,’” the motion reads. “Plaintiff does not allege he or his agent ever responded to the inquiry made by Club’s legal counsel offering to follow up with Plaintiff, with Mr. Meyer and/or with Club management.”

The Jaguars also claim in the motion that they can’t be sued for retaliation under the Florida Whistleblower Act because the team did not instruct Meyer to “assault” Lambo.

“Plaintiff’s case is predicated solely on the alleged criminal acts of Urban Meyer, not any policy, practice or activity of club,” the motion reads.

The veteran kicker said in his lawsuit that he believes the team cut him for reporting the incident. Meyer, for his part, has denied that he purposefully kicked and tried to injure Lambo. The coach was fired late in the season following a string of rumors and reports related to his treatment of players and coaches, amongst other things. Meyer was also fired very soon after the incident was reported.

Lambo, the fourth-most accurate placekicker in NFL history, is suing the Jaguars for $3.5 million, his base salary last year, for emotional distress and the way Meyer’s treatment affected his play.
