Later this month, Hall of Fame quarterback Brett Favre will take the next step in his legal battle later this month as he will be forced to answer questions under oath.

As reported by Front Office Sports, Brett Favre will undergo a deposition under oath on October 26 in the civil case brought by the Mississippi Department of Human Services over millions of dollars in misallocated welfare funds.

“Brett Favre better tell the whole truth and nothing but the truth,” federal criminal defense attorney Matt Tympanick told Front Office Sports. “Otherwise, he can add perjury to his long list of potential charges.”

In a somewhat shocking turn of events, Favre is not expected to plead the Fifth Amendment in the case and is expected to answer questions during the deposition. This is a pretty concerning and brutal situation for Favre because even though he’s not currently facing a criminal investigation, anything he says as part of the deposition could be used in a criminal case in the future.

“It would be my advice to invoke it in this matter,” Tympanick said. “Any statement he makes could potentially be used as impeachment evidence in a potential criminal case.”

It will certainly be interesting to see how Favre handles the situation.
